Janie Perry Limited Data Handling Policy 

Janie Perry Limited, trading as Janie Perry Nutrition (JPN) is committed to protecting the privacy and security of the personal information received from those who contact, or are patients of, JPN. 

This Privacy Notice sets out the types of personal information collected and how that collection, and subsequent processing occurs.

JPN is responsible for your personal data.  For the purposes of applicable data protection law (in particular, the General Data Protection Regulation (EU) 2016/679 (the "GDPR"), your data will be controlled by JPN.

Information JPN collects

JPN may collect and process the following personal data from you:

  • Identity and Contact Data, including your name, address, email address and telephone number;

  • Technical Data, including information collected during your visits to JPN website(s), the Internet Protocol (IP) address, login data, browser type and version, device type, time zone setting, browser plug-in types and versions, operating system and platform;

and if you consult JPN as a patient:

  • Sensitive personal data: In the course of JPN services, you may consult JPN on matters that require the collection and use of sensitive personal information relating to you (that is, information about your racial or ethnic origin, your date of birth, marital status, physical or mental health, sexual life, or other details of your background, life and circumstances;

  • Physical Access Data, relating to details of your visits to JPN premises.

Collection of your personal data

The circumstances in which JPN may collect personal data about you include:

  • when you seek advice;

  • when you or your organisation offer to provide, or provide, services to JPN;

  • when you correspond with JPN by phone, email or other electronic means, or in writing, or when you provide other information directly to JPN, including in conversation;

  • when you or your organisation browse, complete a form or make an enquiry or otherwise interact on the JPN website(s) or JPN online platforms.

Use of your information

JPN may use your personal data only for the following purposes:

  1. to register you as a patient of Janie Perry Nutrition;

  2. to provide and administer JPN’s services as requested by you, including passing appropriate contact data to third party suppliers for example for the purposes of ordering tests or supplements;

  3. to administer and manage JPN’s relationship with you, including processing payments, accounting, auditing, billing and collection and taking other steps linked to the performance of your relationship;

  4. maintaining records;

  5. for insurance purposes;

  6. to communicate with you to keep you up-to-date on the latest developments, announcements, and other information about JPN’s services; to send you details of client surveys, marketing campaigns, market analysis, or other promotional activities; and

  7. to collect information about your preferences to personalise and improve the quality of JPN’s communications with you.

JPN may process your personal data in connection with any of the purposes set out above on one or more of the following legal grounds:

  • because it is necessary for JPN to do so to deliver services to you;

  • to comply with JPN’s legal obligations as well as to keep records of compliance processes or tax records;

  • because JPN’s legitimate interests make the processing necessary, provided that those interests are not overridden by your interests or fundamental rights and freedoms;

  • because you have expressly given JPN your consent to process your personal data in that manner.

JPN will only provide you with marketing related information after you have, where legally required to do so, opted in to receive those communications and having provided the opportunity for you to opt out at any time. 

Disclosure of your personal data

JPN never gives your details to third parties to use your data to enable them to provide you with information regarding unrelated goods or services.  JPN does not transfer your information to other countries. 

JPN may in some circumstances transfer such of your personal data that is strictly relevant to third parties for the purposes of ordering tests and supplements, communicating with health professionals, and in some other limited cases but your specific consent will be sought by way of a consent form that you will be asked to complete.  In such cases, this transfer might involve the transfer of data outside the EU.


Security of your personal data

JPN has in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.  JPN has also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where JPN is legally required to do so.


Updating personal data about you

If any of the personal data that you have provided to JPN changes, for example if you change your email address or if you wish to cancel any request you have made of JPN, or if you become aware JPN has any inaccurate personal data about you, please let JPN know by sending an email to hello@janieperry.co.uk. JPN will not be responsible for any issues arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide to JPN.

Your Rights

You have various rights with respect to JPN use of your personal data:

  • Access: You have the right to request a copy of the personal data that JPN holds about you. There are exceptions to this right, so that access may be denied if, for example, making the information available to you would reveal personal data about another person, or if JPN is legally prevented from disclosing such information. You are entitled to see the personal data held about you. If you wish to do this, please contact JPN using the contact details provided below.

  • Accuracy: JPN aims to keep your personal data accurate, current, and complete. JPN encourages you to contact JPN at hello@janieperry.co.uk to let JPN know if any of your personal data is not accurate or changes, so that JPN can keep your personal data up-to-date.

  • Objecting: In certain circumstances, you also have the right to object to processing of your personal data and to ask JPN to block, erase and restrict your personal data. If you would like JPN to stop using your personal data, please contact JPN at hello@janieperry.co.uk

  • Porting: You have the right to request that some of your personal data is provided to you, or to another data controller, in a commonly used, machine-readable format.

  • Erasure: You have the right to erase your personal data when the personal data is no longer necessary for the purposes for which it was collected, or when, among other things, your personal data have been unlawfully processed.

  • Complaints: If you believe that your data protection rights may have been breached, you have the right to lodge a complaint with the applicable supervisory authority, or to seek a remedy through the courts.

You may, at any time, exercise any of the above rights, by contacting hello@janieperry.co.uk together with a proof of your identity, i.e. a copy of your passport, or any other valid identifying document.

Right to withdraw consent

If you have provided your consent to the collection, processing and transfer of your personal data, you have the right to fully or partly withdraw your consent.  To withdraw your consent please follow the opt-out links on any marketing message sent to you or contact hello@janieperry.co.uk.

Once JPN has received notification that you have withdrawn your consent, JPN will no longer process your information for the purpose(s) to which you originally consented unless there are compelling legitimate grounds for further processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.  

How long JPN keeps your personal data

JPN will only retain your personal data for as long as necessary to fulfil the purposes JPN collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements and, where required for us to assert or defend against legal claims, until the end of the relevant retention period or until the claims in question have been settled.

To determine the appropriate retention period for personal data, JPN considers the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which JPN processes your personal data and whether JPN can achieve those purposes through other means, and the applicable legal requirements.

Upon expiry of the applicable retention period JPN will securely destroy your personal data in accordance with applicable laws and regulations.
